. Green Hills Software, Inc., announces that a panel of arbitrators has ordered Integrated Systems, Inc., (ISI) to pay Green Hills $3.4 million in damages caused by ISI's breach of a VAR Agreement between the two companies.
According to the arbitrators, ISI had an obligation to promote Green Hills products ahead of any competitors' products. While ISI agreed to do this, in exchange for substantial discounts, they failed to live up to their obligations.
"We're pleased that the arbitrators saw the overwhelming evidence of ISI's failure to promote Green Hills products, understood our claims, and decided to hold ISI accountable," said Dan O'Dowd, Green Hills President. "Their substantial award is proof that we were well justified in bringing this action against ISI."
ISI claimed that Green Hills did not provide adequate product support to ISI, justifying ISI's adoption of other products. The arbitrators ruled otherwise. "The evidence proves the contrary," stated the ruling, in response to ISI's claim. As a result, Green Hills was completely vindicated in its performance of technical support to ISI.
ISI's request to terminate the agreement was granted by the arbitrators. Termination of the agreement means that ISI will no longer be able to sell Green Hills products, and will no longer be able to send Green Hills updates to existing ISI customers. "Green Hills always wanted to continue the agreement," said O'Dowd. "We opposed its termination because of the negative impact this would have on customers."
